GENERAL
1 - all advertisements accepted for publication by Coolmarket in any of its printed or online publications are accepted subject to these terms & conditions.
Any other conditions proposed by the SELLER OR BUYER will be void unless accepted by Coolmarket in writing.

2 - In these conditions:
“Seller” means the person placing an advert for an item they have for sale. “Medium” means the publication - printed or online- taking the booking. “Potential buyer” means the person enquiring through Coolmarket about an item for sale. “Adverts” means display, online, email and classified advertising and shall include inserts, supplements and re-directed advertisements. "Buyer" means a person who has secured an item with a deposit or who has paid for an item in full. "Item" is the vehicle, Coldstore, piece of equipment or part that is advertised for sale on or by Coolmarket

3 - all adverts are accepted subject to space being available in the medium at the time

4 - Coolmarket reserves the right to cancel any order without liability in the event of becoming aware of any meetings of creditors, bankruptcy, liquidation proceedings, the appointment of a receiver or administrative receiver over the whole or substantial part of the sellers assets, or any indication whatsoever of financial difficulties.

5 - these conditions and all other express terms of the contract between Coolmarket and the seller shall be governed and construed in accordance with the laws of England and the parties hereby submit to the non-exclusive jurisdiction of the English Courts.

LIABILITY
We will need to carry out routine maintenance and servicing of our servers and equipment from time to time. While we will seek to keep disruption to a minimum we cannot guarantee that the Website will be continuously available on-line. We therefore provide the Website on an "as is" and "as available" basis.

We make no warranty that the Website is free from computer viruses or any other malicious or impairing computer programs. It is your responsibility to ensure that you use appropriate virus checking software.

We are not liable for any failure to perform any of our obligations under these terms and conditions caused by matters beyond our reasonable control.

We shall not be liable for any damages, including without limitation, direct, indirect or consequential damages, howsoever arising out of your use of the Website or Products obtained through Coolmarket.

We offer a limited warranty / guarantee of 30 days for all products sold through Coolmarket regarding replacement or repair of products only if proven as faulty material or workmanship by Coolmarket

We can agree specific warranty on equipment if agreed specifically in writing at point of sale with Coolmarket.

OWNERSHIP
Copy must conform to Coolmarket’s requirements and Coolmarket reserve the right to charge for any additional work involved in amending the copy of the advert to conform to it’s requirements.

All rights, including copyright, in the content of coolmarket.co.uk and in the photographs of any items displayed on the Website and all database rights, are owned or controlled for these purposes by us.

All trademarks, names, and logos are the proprietary marks of us or of our associated companies. Marks identifying third parties are owned or licensed by those third parties or their associated companies. Nothing in these terms and conditions in any way confers on you any licence or right under any trade marks, names or logos.

You may not copy, reproduce, redistribute, download, republish, transmit, display, adapt, alter, create derivative works from or otherwise extract or re-utilise any of the contents of this Website. In particular, you must not cache any of the contents for access by third parties nor mirror or frame any of the content of the Website nor incorporate it into another website without our express written permission.

MINIMUM ORDER
While Coolmarket is committed to supplying the quantities you need, third party sales may be subject to minimum order quantities.

CUSTOMS AND IMPORT DUTIES
Coolmarket does not collect import duties or customs taxes and has no knowledge of what these charges may be. If you are responsible for these additional charges, you will be required to pay them in order for your item to clear customs. For more information regarding your country's custom policies, contact your local customs office. Customs and import duties remain the responsibility of the importer/buyer. See EXPORT.


EXPORT
We are happy to manage export sales. Please contact us for further information. Coolmarket cannot arrange vehicle inspections, certificates or insurance relevant to the importing country. All inspections, certificates and insurance remain the buyers/importers responsibility and must be arranged and paid for by the buyer/importer direct. Once inspections are booked, Coolmarket can liaise with the inspectors on the buyer’s behalf. Inspections can be carried out at Coolmarket’s premises. Shipping can be arranged directly by the buyer/importer or Coolmarket can arrange shipping on the importers behalf for an additional fee. See SHIPPING. Full payment with order is required for all export sales.

USED VEHICLES & EQUIPMENT
All used vehicles, Coldstore and equipment purchased through Coolmarket will be sold “As Seen” or with 30 days parts only warranty. Unless alternative Warranty agreed in writing at point of sale with Coolmarket. Used vehicles may be modified with new equipment or new vehicles and equipment may be supplied by Coolmarket. In this case, the new item will be subject to the conditional manufacturer’s warranty. It is the buyers responsibility to confirm and adhere to the conditions of the manufacturer’s warranty. See WARRANTY. Once ordered and secured with a deposit it is the buyer’s obligation to complete the transaction with Coolmarket. If a buyer chooses not to view the vehicle prior to order they remain responsible to complete the transaction as per their order. Used vehicles and Equipment may not be sold with manuals, spare keys, spare wheels, wheel braces or jacks.

SELLING (VEHICLES AND COLDSTORES) COOLMARKET SALE
Coolmarket will sell the item on the sellers behalf; No Sale-NO fee. No fee is charged for uploading the advert. All negotiations will be carried out by Coolmarket. Sellers will have no enquiries directly from potential buyers. Advert display will be up to five photos and a maximum of 30 words. Additional photos are required from the seller to send to potential buyers. The minimum acceptable price should reflect the current trade value of the item. Coolmarket will advise the seller of the current value of the item at the time of advertising. Coolmarket will purchase the item as a Trade Sale from the seller, unless otherwise agreed in writing, the fee is added to give the selling price which should not exceed the current retail value of the item. The fee will be determined by Coolmarket and will be Coolmarket's commission for the Sale. This fee will also include repairs, modifications and warranty offered by Coolmarket to the buyer. Coolmarket will negotiate the selling price with potential buyers, no lower than the sellers Minimum acceptable price, unless agreed with the seller in writing. If we do not find a buyer, there is no fee. Your items will usually be displayed on the site within 24hours of receipt of your written confirmation to advertise, the full details of the item (including damage and defects) and photos showing all sides, internal and external. The seller is responsible for supplying Coolmarket with correct details of the item for sale. The seller is responsible for advising Coolmarket if the item is no longer for sale or if the seller no longer wishes for the item to be displayed. All items in a Coolmarket Sale remain the property of the seller until paid in full.


PAYMENT DETAILS (VEHICLES AND COLDSTORES) - COOLMARKET SALE
For vehicles and parts, payment in full is required with order, unless otherwise agreed in writing. For Modifications, Coldstores, containers, towing trailers and new builds, 60% deposit is required with order and balance is required upon completion, before collection or delivery.  See DEPOSITS. In all cases, without exception, full payment is required before or upon delivery or collection. Items will not be withdrawn from sale or held for a buyer until a deposit has been received (cleared funds).  Once Coolmarket have received cleared funds of a deposit this will form a binding contract. Prices cannot be re-negotiated once a deposit has been paid. All items remain the property of Coolmarket until paid in full.

PAYMENT DETAILS  - ALL ITEMS
Our preferred method of payment is BACS/CHAPS bank transfer. Bank details will be on all invoices. Coolmarket can accept Credit and Debit card payments, via PayPal, there is a 3.5% transaction fee for these payments. Finance packages can be arranged through a third party. All items remain the property of Coolmarket until paid in full. Items will not to shipped/released for collection until paid in full.

DEPOSITS
Coolmarket require either payment in full, or a deposit of 60%, unless otherwise agreed, with the balance being payable before collection or delivery. Deposits are taken to buy in vehicles, materials and to carry out modifications, builds or refurbishments. In all cases, deposits are non-refundable. Refusal to pay the outstanding balance before collection/delivery date will result in item being advertised for sale. All items remain the property of Coolmarket until paid in full. If exporting a vehicle full payment is required with order - see EXPORT.

DOCUMENTS
All vehicle documents and documents of ownership will remain with Coolmarket or the third party seller until the item has been paid for in full. All vehicle documents and documents of ownership will be sent with the vehicle to the buyer upon completion. If requested, documents can be sent prior to completion (but only if paid for in full) by courier at an additional cost.


BUYING USED VEHICLES AND EQUIPMENT
All items are sold as seen, unless otherwise agreed. An item is only reserved for a buyer once Coolmarket has received cleared funds of the deposit or payment in full, whichever is agreed. See PAYMENT DETAILS (VEHICLES AND COLDSTORES) - COOLMARKET SALE, PAYMENT DETAILS  - ALL ITEMS and DOCUMENTS. It is the buyer’s responsibility to ensure the item is accurate for their requirements. No refunds are offered. Coolmarket therefore recommend that buyers view used vehicles prior to purchase. If the buyer declines to view a vehicle before order, the payment of a deposit forms a binding contract to complete the transaction. Once the buyer agrees to buy an item, agreement to purchase and request for an invoice is required in writing. An invoice must be paid upon receipt of the invoice, unless otherwise agreed in writing by Coolmarket. Items are not held unless paid for in full or secured with a deposit, unless otherwise agreed in writing by Coolmarket. Modifications, Coldstores, containers, towing trailers and new build jobs will not be included in the workshop schedule until a deposit or full payment has been received. Estimated completion dates will only be given once the job has been included in the workshop schedule. See COMPLETION DATES. It is the buyer’s responsibility to keep up to date and abide by the current vehicle licensing laws. It is the buyer’s responsibility to keep up to date and abide by current LEZ compliance standards. It is the buyer’s responsibility to keep up to date and abide by current import inspections and certificates - see CUSTOMS AND IMPORT DUTIES and EXPORT. It is the buyer’s responsibility to obtain a valid certificate of insurance.

SHIPPING
Shipping is not included in prices shown for items on Coolmarket. Shipping should be arranged by the buyer, unless otherwise agreed with Coolmarket. If the buyer requires Coolmarket to arrange the shipping on their behalf, an admin fee of £400 will apply. Inspections, certificates and insurance of the item is the buyer’s responsibility. See CUSTOMS AND IMPORT DUTIES and EXPORT.

DELIVERY
Delivery is not included for any items shown on Coolmarket.co.uk unless stated. Delivery can be arranged by Coolmarket to any UK mainland destination, price on application. Where delivery is indicated as being included in the price, this applies to all destinations within a 100miles of Coolmarket - please enquire for such items with your postcode to ensure you qualify for included delivery. For Coldstore and container delivery please supply your full postcode and indicate if you have access to lifting gear and if you have trailer access.


COMPLETION DATES
Completion dates are estimated only. While coolmarket endeavour to complete all jobs within the estimated time, this is not always possible. Coolmarket accept no responsibility for delays with third party delivery companies.

CARRIAGE - PARTS SALES
All carriage costs will be determined at the point of sale. Quotations for carriage costs prior to an order will be estimated only and subject to change. Carriage costs are chargeable to the buyer, unless otherwise agreed in writing.

CANCELLATION
Cancellation or suspension of the advert by the seller must be received in writing by Coolmarket as soon as the item is no longer available. Coolmarket reserves the right to omit or suspend an advert at any time for good reason, without liability to the buyer and shall notify the buyer as soon as possible. If such omission or suspension is due to the act of default of the Seller or their agents, then the seller shall pay for the advert in full notwithstanding that the advert has not been published. In cases of an order for an item being cancelled by the buyer; these items will remain the property of Coolmarket or third party seller. See DEPOSITS.

WARRANTY
No warranty is given unless otherwise agreed in writing.  Warranty of any product supplied is limited to the repair or replacement of a part of the product that proves defective because of improper material or workmanship caused directly by ourselves, under normal use and maintenance. If Coolmarket’s Parts only warranty is offered, this is valid for 30 days only unless agreed in writing at point of sale. Parts can be supplied by Coolmarket or Coolmarket can be invoiced for the parts costs. Travel and labour costs are the responsibility of the buyer. If 12 months manufacturer’s warranty applies to any NEW items it is the buyers responsibility to confirm and adhere to the conditions of the manufacturer’s warranty. Failure to adhere to the manufacturer’s warranty conditions will result in warranty being void. Warranty doesn’t cover damages caused due to acts of God and force majeure.
